It doesn't matter whether the angle is the same or not... It isn't an exact rip. I had people complaining that my hud was ripped from GR:AW when it clearly wasn't. All I was told was to make the hud look like it. I guess they've done the same thing.
The whole thing about IP is a bit hazy. But basically, if you made your own similar copy of it by eye then it wouldn't be infringement. After all, if as soon as someone drew one thing and said 'thats my IP', and it immediately became illegal to draw something similar... the whole world would fall apart.
