The fifth one, because if it went up in rungs, that would imply that the boat isn't floating. The boat is floating, so, it has to be the fifth one.

how u figure the top one obese?

if at low tide the 5th rung is above water, then wen te water rises, the boat rises equally and the 5th one will still be the first one above water

I'll give this a try. It is an old riddle I heard a long time ago. I just made it rhyme a little:

A rooster rises like an alarm
as the sun rises in the east.
It is standing on a peak of a barn,
then lays an egg for your morning feast.
Which side of the barn
does the egg get released?

I thought it was a trick and was always the top because you count it first. If you'd have said "how many rungs will be underwater?" I might have got it. Good riddle
