Geek Culture / Piracy vs theft...

In one of my moments of deep thought the following came to me

If someone took my DVD copy of a software program or a movie are they guilty of theft, piracy or both? At first it would appear to be just theft, but if I use the copy installed on my computer and no longer have the DVD am I a pirate? How about if I watch the movie I ripped to my hard drive from the DVD that was taken?

Perhaps I just need more sleep

Haha, Piracy is merely the act of downloading (they must PROVE you DOWNLOADED it by a given IP, etc.) a piece of licensed software. If you were to put that software you downloaded on a DVD and give it to a friend, he/she is only responsible of piracy if installing this software outside of a trial basis.

In other words, if they didn't install it/watch the movie they're not guilty of piracy, only of theft.

Piracy is the unauthorized use or reproduction of copyrighted or patented material. So if you give the ripped movie to a friend, you and he would be a pirate. Of course, this doesn't apply if you are in Switzerland

simply putting it, noone should even need to ask this, piracy and theft are both just bad. dont be a bad person.

Technically no, but as long as i own the game, i see nothing morally wrong with it, and if i'm not caught, what the hell?

Theft. Piracy is the operation of taking an unauthorised copy. Depending on the country you are in, the fact that you made the original copy anyway may or may not label you as a pirate, but the thief is still just a thief.

Then you would still be the legal owner of the license to use the software.

Again, in some countries you are allowed to format-shift and in some you aren't.

As far as i'm concerned the lines are still quite blurry.
As far as i'm aware, legal or not, no one is going to press charges if you're keeping personal backups of software, music or dvd's, the problems occur when you give those away or sell them to friends. I do think it's slightly different within different media though, i do burn separate copies of music cd's for the car, but that's about it. Creating copies of software(especially downloaded software) as a backup is usually a must, so I don't think anyone would frown upon that as much as a backup of a DVD. You can't help but be cautious when somebody copies a DVD disc for 'backup' purposes.

I never said I would illegally download something i Didn't own, but if i already had a copy, and was backing it up, in my opinion, there's nothing morally wrong with that.

wrong, it is the same as if someone would have stolen a TV and given to a friend, the friend would be guilty for co-op of stealing. something liek that.

Say you owned a game, in this case, for the hell of it, Big Rigs.
You owned it. then you lost the disc, but you had your manual with a YOUR keycode in it.
Is it piracy if you download a copy of Big Rigs, but then use YOUR keycode from YOUR LEGAL version?

You paid for the content not the physical disc. The only shady area is where you got the download from and whether you paid a pirate for it (garrr!).
Personally I wouldn't have a problem with doing that myself but on the other hand it seems a bit like forgetting where you parked your car and then deciding to steal one that was the same make and model.

However it differs considerably in the fact that data can be reproduced quite simply whereas only one person can be in possession of a car

sick enought it is piracy and tbh, it shouldnt be.

basicly, as long as it is an commercical software which costs money, and you download it for free, it is illegal piracy.
