From the US Copyright office:

"(2) Computer programs that enable wireless telephone handsets to execute software applications, where circumvention is accomplished for the sole purpose of enabling interoperability of such applications, when they have been lawfully obtained, with computer programs on the telephone handset."

"(3) Computer programs, in the form of firmware or software, that enable used wireless telephone handsets to connect to a wireless telecommunications network, when circumvention is initiated by the owner of the copy of the computer program solely in order to connect to a wireless telecommunications network and access to the network is authorized by the operator of the network. "

So not unlimited jailbreaking ability, but I suppose a step forward. I'm still a supporter of anti-circumvention technology to keep piracy in check though.

Apple must be fuming, if people can get flash onto their iphones and play free games it will cut into their app sales.

I doubt it'll hurt their sales much since most of the apps you'd get on Cydia are things you can't get from Apple to begin with.

Apple has already stated that jailbreaking your phone will void their warranty though =/

Can't you just reset the firmware and it's like new?

I've got an old 1st-gen iPod touch. Not jailbroken, but I don't really see any reason not to. You can still get on the AppStore, right?

Yea you can still get on Apple's store. Mine is jailbroken only because I use a different carrier.

I think this is a bit odd, how can the law stop Apple from keeping it exclusive? What if games companies were allowed to make Playstation games without giving anything to Sony?

A large reason people jailbreak phones is to get a different carrier. AT&T isn't too popular with a lot of consumers and they don't like being forced to subscribe to them.

Programming code is actually classified as literature under U.S. copy right law. Running jailbroken firmware only alters 50 bytes of code out of 8 million. That isn't enough to be considered an infringement.

Thanks for posting that Sid, definitely more changes took place than I was aware of.


And incase anyone was curious or wanted to know, I have successfully updated my iPhone 3G from 3.1.2 to 4.1. Instead of Blackra1n I used Redsn0w this time around. I was hoping to try out the http://jailbreakme.com website, but after I updated my firmware I was no longer able to access anything due to not having an AT&T sim card (i technically have one, just wasn't on me at the time). So using redsn0w worked. I was then able to get an update through Cydia for the carrier unlock. My only issue so far is I haven't gotten MMS to work yet, a minor issue in my opinion.

To me it seems like battery life has improved slightly. Either from something in iOS4 directly or removing something I had done before that was affecting battery life.

I'm amazed that it's become so easy to Jailbreak an iTouch/Phone that you don't even need a computer anymore, you can do it on the iTouch/Phone now, in the most ridiculous two steps: going on a site and sliding the bar at the bottom. Thats it!

So you're saying (i'm assuming you're a software developer :p ) that you wouldn't mind your game or whatever being modified and resold and pirated?

That's a bit different. People aren't modifying their phone for resale but for private use. A better analogy is like saying you bought a new HD tv but you're only allowed to use it with a specific cable company. The argument is, I bought the device and I'll use MY device as I see fit. Kinda similar to the issue with modding playstations or when microsoft tried to say its illegal to install linux on an xbox. The most any company should be able to claim is that it voids their warranty.


Sasuke, Apple just released 4.0.2 firmware that is suppose to prevent that method from working, which used a pdf exploit in safari from what I understand.

Looks like Apple will be releasing a version of the iPhone 4 in Canada that's already unlocked... this should be pretty interesting. We will have the option of legitimately purchasing it without a contract, at a high cost, so we can shop it around to our favourite carriers. Cool!
