the amount she had to pay was still an insane amount of money, HOWEVER, i definitly agree that she broke the law and she should be punished somehow. No questioning that!

She should have to pay back what she earned and a penalty. $88,000,000 is just ridiculous, most people don't even get to $1,000,000 in their lifetime.


I'd love to see things from your point of view but I can't get my head that far up my bum.

You agree to the license when you hit 'I agree' when the terms of use appears. Though, generally, you have to do that before you even get to run the program. Nobody ever reads them and tend to be completely oblivious of them, but I tend to if it involves money coming out of my bank account...I tend to want to know about every charge that can be made to my account and that I'm not stepping over any boundaries, like when signing a contract to start renting a place, you don't want to find out that your deposit is forfeit because there's ketchup on the underside of the table.

[Note...I will have to admit that largely I'm speaking from opinion, and not solid fact]

Honestly, unless a private server runs off of 100% its own content...it's taken something from Blizzard.

Models, scripts, NPC names, dialog, all of these things were created by Blizzard.

I really don't understand all the arguments claiming she is innocent. She hosted a commercial game, that was not of her own making. I'm willing to guarantee she used Blizzards content. Period. A private server, unless someone takes the time to 100% recreate the game, models, code, dialog, everything, the simple fact of the matter is that they stole Blizzards content as a method of making money. And so what if she wasn't the one getting on and playing? She facilitated the entire process. She provided a place and method to play commercial content which was not her own.

Saying she's innocent for not being one of the players, is like saying that a person who uploads an illegal torrent is innocent...they didn't download it right, just made it available? Yet for some reason...it seems that you get slapped with bigger charges for facilitating piracy than participating. Yet I haven't heard an outcry for this, except by those who support piracy.

To me...private servers are just another way that people pirate games. They set up or access private servers because they don't want to pay for the actual game, but still want to play it. Sounds almost exactly like piracy to me.

She's certainly not innocent. She committed a crime against the the people who made the game and she should be punished accordingly.

She definately should have had to pay back what she made. But, honestly, I think the "penalty" she had to pay should have been a year or so of prison, not a life long monetary debt.

that depends really, i mean you could easily set up a private server where you and your buddies can play, you still need to buy the game to be able to download it from their website. And really, playing an MMORPG with a few buddies is hardly even close to the real deal, i personally do not see that as stealing, as you bought the software before. However playing on a big private server is a bit different, since there is a high number of players there
I personally have never played on a private server, ever, they just dont seem...

It's always good to read those user agreements before running a program. A weird bit in the WoW user agreement is, if you don't actively RP on a RP server you can be banned. True story.

thats not weird, because if they didnt have such rules, guys would just go to a RP server and ruin for the other players. This happens all the time in RP servers on gta san andres multiplayer.

not having an RP name on an RP server would have the same penalties as having an *bad name, using bad language* on a normal serv, which is ban, or they change the name for you

Agreed, but then her being in prison wouldn't make the company any money...
