Geek Culture / Illegal O2 phone blocking

Well ill get to the point.
Brand new phone from Hongkong, been using it for about a month and i wake up this mourning to find O2 have blocked it because they think that ive been using a pay-as-you-go Sim that was lost 2 months ago.

Now Im on Virgin 12 month contract.
Nevermind the fact that the sim was supposedly lost 2 months ago and the person only reported it missing today, or that its a pay as you go sim. ( you literally topup when you need it so its useless to rob) They now cliam that even with my personal details and proof of purchase through paypal, that the phone has been using there sim and that they will not unblock it.

They refuse to do anything about it and i should bin the phone according to the manager. Now its a £90 phone brand new phone sure its not £350 iphone but thats £90 im out of pocket for there mistake, an ill be another £90 out if i have to buy a new one.

Now is this legal in anyway at all?
All evidence points towards it being a mistake and yet they keep saying they won't do anything about it. Im just looking for advice here since it's complete and utter bull that they think they have the right to do this.

So any thoughts or advice?

I'd try meeting one of them personally. But there's not much you can really do... I'm not sure about the legal issue, you will have to check into that. What about just buying a new sim card? They only cost ~30 bucks (or less, depending what currency you have). All of your data will still be on the phone, and you will be able to use it again

Misunderstood, i have never touched a O2 sim and one has never been in my phone but O2 is saying there has and are blocking the phone itself. Even with evidence to say its my phone and not stolen and ive only used my sim. What would be the point in using a O2 sim where i'd have to add money to it, when im on contract with a different network Virgin media for unlimited credit?

In the UK by blocking i mean you can no longer phone in/out or text on ANY sim card. So it's pretty much a £90 paper weight.

Even after they we're proven them wrong by the call logs, receipts, virgin contracts and even common sense they refuse to unblock the phone. So this is all on there end and there making me pay for it basically.

Take them to the small claims court would be my advice, at least there you can get someone who will actually care about your plight.

Small claims court sounds like the way to go here - usually those three words make them get up and do something about it

I'd get in touch with OFCOM or try to sell the phone abroad (the IMEI blacklist is a national list, rather than international).

Thanks for the advice guys, Im not a money grabbing leech but ill threaten them with a small calims court and see if they do anything, otherwise ill take them to it.
I literally just want the phone back in use aha Its not like ive got money to throw around and forking out another £90 for a phone just dosnt register on my priorities, ive been using a samsung G600 for the last 5 odd years and only the camera is gone on it, i thought a new upgrade would be nice guess this is the second time ive been wrong, i got a samsung wave which died within two weeks and now this

Ill tell you how it goes tommorow

Im not so sure what you can actually do except be a smart consumer and say screw you guys. If your on a contract dont honor it dump it and tell them to go to hell and get on with another company. My dad had a similar thing happen to him were they said that they couldnt confirm his identity and they shut off his fone.... he talked to them and had it worked out and the next week they did the same thing to him... his bill was paid and he couldnt use his phone because they were idiots and couldnt get their ties straight. (ive used all my $hirt tokens). Small claims will just bury you farther... just treat it like a bad relationship and dump their behinds fast. Theres someone else out there that has all the lovin you need... (A home phone...LOL)

have you tried bringing this to virgin? it may be O2's mistake but you're on a virgin contract, they may be able to do something about it, even if it is as little as them providing you with a list of contacts/ references to use when bringing this up with O2
