The publisher can demand whatever the hell they want, otherwise they won't publish your game. You're in the weaker negotiation position, since they have the cash to payroll development in the first place
Also Maxis is a subsidiary of EA, so yeah, what EA wants will directly translate into what the product is

Crytek has relationships with Ubisoft
and EA, as well as the fact they get cash from their engine and tech. licences. So they're in a much stronger position to say "This is our game: take it or leave it". They are also not a sub. like Maxis is.
