smb combines me and the other 2 company directers last names

You could think of accronyms, abbreviations all day long that would look or sound simiar to anything you will think of.

As long as it doesnt seem to be an intential mis-repreentation no one is going to smash you in the face with a hammer.

If anything at all, your first contact on the issue will be a cease and desist request. Which is handled properly can result in your favor. As shown in the example by Phaelax.

Ive recieved Cease and Desist requests from other websites and small companies before, all three of my personal experiences ended in me selling the domains to the requesters, it is not the end of the world.

Also... I think I speak for most people on the forums when I say that things like:
"We here at smb studios"
"my/our company is"
are really annoying, coming from people who don't actually have a registered company.

From people like the maintainer of ledworks, it's fine, but from people still asking "what's an integer" on the forums, it's really annoying.


Tell me if there's a broken link to images in a thread I post, and I'll fix 'em.

well i know what that is i have a full understanding of visual basic and so do know programming but visual basic isnt good for game development and i cant do c++ just yet so for now im using dark basic but after i plan to use unity 3d and after that create my own engine

Firstly, it's spelled directors.
You have to register to be a legally trading company, have you done that? If not then you are just a bunch of guys making games, not a company!

There is no shame at all in being a bunch of guys making games, so I am perplexed as to why so many people come up with this crap facade pretending they are a company and referring to themselves as "we" even if it's one person on their own! It doesn't make you sound professional, it's fake, people know it's fake, and they will assume your game is as much of a joke as your "company".

It's good to have a name for your team, but don't pretend you are a company.
SMB will get confused with Super Mario Bros. so don't use that, also I'd recommend against using your names in the team name, what if the team changes, then you still have the name of someone who isn't in the team any more.

my advice is take a look at the moddb developer page and look at, not necessarily the AAA studios names, but the indie companies which stand out to you, It will hopefully show you what things to avoid calling your company, you want a unique name

and don't forget to Google your company name, check its not used

SMB is generic enough that anyone going down the C&D route would be crazy.

When I saw SMB, I thought 'Small and Medium businesses', so that probably makes it obvious that I'm not a child of Nintendo, and I've never played a Mario game in my life.

The real point of course is that you're putting the cart before the horse. I know it's all in fun, but there are many steps and considerations to establishing a company that come before picking a name. Picking a name before establishing what your company is about will almost certainly guarantee that you'll want to change it later.

You could also choose a name that is unique

For example, I have established my company name as Reiika (registered as a LLC)

The first name it gave me was "Sticky Sugar Studios", that's awesome! Use that blue fire! By the way, why aren't you calling your "company" Blue Fire Games? Who is blue fire games if that isn't your "company"?

You don't need to register as a company dude, just get the game out and then you can worry about that stuff later when it is necessary. At your stage, registering as a company would just be a waste of money.

Try to think of something original, something more than just an adjective and a noun. Personally, I always liked the name: Day 1 Studios. Your original attempt was a good idea but like others have mentioned, it's too ambiguous. However, for an indie game team I think it's best to have a 'fun' name. Something, that's funny and shows that you guys are having fun with your games as opposed to something on the more serious side.

Blue Fire,

Not sure where you are located, as in country, but if you are in the US you can register a DBA (Doing Business As) as a sole proprietor at your county clerks office.
This will allow you to do a number of things under your "company" name:

Register a PO Box
Open a Bank Account
Accept Checks
Get Sued (Sorry had to throw that in there )
Track your spending so you can separate your personal expenses / belongings from you business assets, for tax purposes and helps protect your personal assets from a suit againts your business.

Regardless if people among the forums find it annoying or not, regardless who they want to use as an example of:
It is okay for "this" or "that" person to do it, "They are awesome".

If YOU feel the need or want to do it, then do it. Who cares what other people think your knowledge base has to be in order to run a business.

Company names are really tough to choose because there are so many things you have to think about. Back when I started my computer build/repair company (no longer doing it officially). I wanted to use "Obsidian Computers" but couldn't think of a cool enough logo or even a byline to go with it so I went with "Stellar Computer Systems" with a byline "We're way out there but our prices are down to Earth." with a sun-like logo. That byline sounds kinda silly to me now but that was when I was in my early 20's.

thanks for the advice special thanks to oneka for giving a good suggestion and also that random company name generator im [mod edit]under 18 and now find myself on post approval for posting my age...if only there was something like an AUP which could have told me this[/mod edit] and i wouldsnt use those stupid names if my life depended on it after all when it gives me horrible games studios you most probably get why

Don't post your age. His company name generator is just meant to be funny. But your name is "Blue Fire Games" and you just barely joined on April 29th and 6 days later you posted you want to now use "SMB Studios" as a company name. If you change company names that quickly you're going to need that generator.

Hi guys been a while... life got hold of me...

umm, my two cents here, I agree with those saying not to link in your names... I am currently incorporating a new copany (will be a limited company, either PLC or LLC not decided yet I got a lot of reading to catch up on) and also going for a trademark registration now as well, some things I took into consideration was, is the domain name available... (this is now really no matter what anyone says, your ONLY direct public face... if you havent got a domain you technically do not exist to anyone to be honest...) so make sure its not taken, especially not in .com ...... the second, what form of legal existence are you aiming for, sole trader, limited, public limited... private limited? etc... also umm about the getting sued, if your in america, expect to get sued no matter what your status, lol as far as I am aware lol and umm finally the name... seriously from my professional opinion... unless your gonna be selling down some sunday market / car boot sales doing food or trinkets... do not use personal names in the name, or unless your a lawyer opening an office lol... but think of something that relates to you, and gives you a certain motivation a name with character that in a platinum way is a shining beacon for your inspiration, something you will be more than g*d dammed happy to pick up the phone and say 'Hello [XYZ COMPANY NAME HERE], how may I help you today?', because without the motivation and enthusiasm for your company, the inspiration and self interest dies down pretty fast and you soon find yourself doing something else like a part time job because you can not be bothered doing what you thought of in the first place...

If you make a company as a sole-proprietorship or partnership if the company folds and it owes money to anybody if your name is on the company paperwork (like the CEO) they can take your personal assets. With a corporation the company is technically a person itself and any assets that aren't under the company name are protected (which allows you to keep your house, car, and x-box Mr. CEO of a failed company).

...depending on the scale of things. If you're running a partnership and you lose £1000/$1000, then it's not a huge deal. The cost of running a corporation/limited company will far outweigh this loss, as you have to employ a certified accountant and submit your accounts each year, as well as pay an annual fee simply for being registered. You also have the incorporation costs, the need to elect a board and chairperson (even if it's just 2 people), and many other overheads. It's also highly doubtful you'll get a low-cost bank account.

corporations are a little more different than limited liability... not sure which hes on about there... but yeah being incorporated does incur additional expenditure
