What are the legal issues associated with buying a model pack - repackaging and editing them - then distributing the edited models with a GNU licensed independent engine written by me.

It would equal a ban and probably a big fine

But when you sell a game using the fps creator engine with a model pack (which is advertised as possible) would that then not have any issues? And if this wouldn't would it then be acceptable for me to pay for a copy of the engine to be able to distribute them?

On the official Licensing page:
Quote: "Does this license cover games built with the engine source code?

Yes! If you download the FPS Creator Game Engine source code and recompile it, you are still permitted to sell your work free of any license.

Selling games you've made

We are pleased to announce that there are NO license restrictions on FPS Creator. You can sell whatever you make and do not have to pay us any royalties. This entitles you to sell your games on your own web site, sell via a publisher, have them placed on magazine cover discs or just give them away for free. The choice is yours. While we'd love to hear about any success stories resulting from FPS Creator built games, you'll never have to buy a license from us."

I am not wanting to take credit at all for the models - in any way, but I would like to distribute edited versions with my game referencing the original art.

You should read the faqs on the fpsc home page, but I will paste the here for you.

Quote: "1.Q: What copyright issues will there be with games I make?
A: In a nutshell - none! You will be able to save EXE files without any restrictions or water-marks / splash screens. These can be given away for free, or sold. There are no commercial restrictions on the sale. If you make a killer game and earn thousands from it you don't owe us a penny. You can sell the games on your own web site, or you can sell them to a publisher, it's up to you. Please keep us informed though, we'd love to hear about it!
2.Q: Does the "no royalty" license include games created by modifying the game engine source code you've released?
A: Yes. There is only one restriction regarding the game engine source code - and that is you cannot use it to create another "Game Making" type of application. But other than that, you can do whatever you like. "

I might be off on this, but if I remember right, if you edit something in a model pack and want to say give it away then you must contact the author of that pack or contact Rick or Janet to make contact reguarding redistribution of the models in the pack or packs.

Obtaining permission is a sure way of staying out of the copyright problems with anyone. Some may put a price tag on it,while others may not.

Also if you are making a game not using fpsc, they do have stand alone packs which still allows you the rights of using those packs.

I leave with one final thing to say. Permission is the key. If you don't know if something is copyrighted always ask the source, but if the source cannot be located or is no longer in service then I would say use at your own risk or don't do it at all.

I hope this helps, but then again I could have read this post wrong.

if you're planning on selling your game, just make sure every model you use allows commercial use.

Its just a hobby project, I am basically doing a rewrite of the Id Tech 3 engine in the Ada programming language. However, the code in the Id Tech release is under the GNU public license meaning that any modifications I make have to be release free of charge and the source code made available which is why - if i bought a model pack from fps creator - I would need to release any models it uses free of charge as well if I want people to play it with the content.

TGC pack licensing is incompatable with GNU licensing. You would have to find media which was originally released under a GNU license. Packs do not use the same license quoted above.

However, the stock media which is included with FPSC-FREE might have more wiggle-room. Emailing RickV and/or Lee of TGC for confirmation is the only way to get a definitive answer.
