I have saved all my files to the internet and lost my pc, I could not pay for it. I am getting one in three days and please do not lock this thread. I will use a friends pc for support if it is needed.

I want to do this but do not have a pc yet, still waiting for one, right now I am on my friends pc that can hardly do anything, so I am just using it to communicate.

This is my plan, I also have just made it to where if you contact me with your info,you can upload a product to sell or give away for free.

I am working on this, trying to learn how to animate 10 frames to look as natural as it can, I do have some in great posses,like hands on hips while talking, one hand on hip so on.

It is hard to make a guy gesture with 10 frames, but I am trying, I almost got it down, so please stay tuned.

We may be interested in purchasing what you have so far (and future media) for our developments, but there are a couple questions to ask first, since you mentioned working on character(s) in Max.

1. What kind of license do you provide the purchaser? For example, commercial, non-commercial usage, etc.

2. What restrictions are on the media? For example, is it to be used in FPSC only, or are other engines allowed?

3. If there is an issue with the characters in a development, what support is provided?

If my questions seem direct, that is because we do not do this as a hobby and have commercial developments on the table. I cannot afford to purchase media to find out that either no license is provided, or that commercial usage is given when it should not have been. We have a company to protect (as well as our clients we develop games for) and want to ensure everything is clear and above board.

You can not edit any model then sell it,you might get in trouble, not by me,but by 3ds max, as the license is only for what I create.So you can use any media created by me in any project commercial or not as long as you do not sell my media to others in any other different projects other then gaming or films.

2.All my media can but used in what ever you wish,like on my web site it says, any project.

3.I will provide any type of support for any thing I sell as long as it is understandable support. Meaning,what you buy is what you buy. If you see it, like it, buy it, then it is yours, but I will help you with anything you need for the said media.

The products have no license in the files, but I am changing it in a couple days, so till then, it is written here for proof my friend.

With that being said, I look forward to doing any business with you, I also do side projects, I already rigged three models for talking for another client.

Any support issues would only come from us as developers, and most likely it just might be an email with a screenshot(s) in case we have imported the media into a development and have "strange" results. Most media we can import into most engines with ease- there are some times where a strange anomaly appears and we like to keep the artist informed in case others have similar issues.

The reason I asked earlier is a lesson we had experienced. We contracted out some development work to an individual since we had multiple developments on the go. The development was completed and we were going through a final test/check before packaging. It came to our attention this individual was using a "student license" of 3DSMax, which caused us some issues. First, we had to pull the media from the development, then find proper media to fit the development before the end of deadline. The term "proper media" does not only include model(s), but the licensing/terms of usage which we have to include with the finished development to our client(s). Otherwise the client(s) could have been audited, which leads to us, and so on. It becomes a mess, which is something we want to avoid. Being that we are a business, we need to ensure any media contains a proper license. If media is made with a "student license" of Max, the EULA is very clear on its usage-

So providing "commercial license" on media made in software means that it was made in the correct license umbrella. That was why I asked because it does not bode well for people that use media in commercial releases that technically are not permitted per the EULA. We need to ensure all media we use contains proper licensing and permissions so that nothing can fall on our client(s) or on us. That info must be included in the package we distribute to the client(s). We have to check everything with the client(s) we deal with.

Hope that makes sense, and thank you for the clarification.

Autodesk have no rights to any media created using properly licensed software. You own these rights, provided you own the license when you created it, it's your work not theirs.

The rental plans your referring to applies to cloud storage of files and online verification and renewal of rental software licensing, Max is much more than a modeling program, hence the reason it's insane to purchase a full license or even rental if thats all you intend to use it for, and output of media and models themselves is your own work and not restricted to a rental period unless the media created is kept solely on the cloud server and cannot be exported in the normal way.

I wanted to look into the rental plan as well. Did you purchase this from their web site or go through a reseller? The Autodesk site seems a little hard to find this option.

I keep threatening to buy Max but everytime I have my credit card in hand I get scared and back off.

I was unaware that 3DSMax was under a *rental plan*. When did this happen? If your Max is under a "rental plan", does the EULA allow you to provide us with permission to use said media in commercial products?

Do what we did. I had to purchase AutoCAD, AutoMap, and Max. In CAN funds that is a lot. I got to purchase software, my wife got a new car. It all worked out.

a reseller here in Colorado, I bought it a while back, but my license expired, so now for right now,I rent as cheap as I can till I can afford to buy it.

this time,it will be the full license so it never expires. I am in contact with some one willing to let me make payments on 3ds max right now. My advice?

If you buy my stuff, do not use the 3ds max files just the .x files with my rental. After I buy it with payments, you can then do anything with the 3ds max files. its the 3ds max files that is illegal to sell, not .x files or .obj files.

You can also borrow a license, its right in your 3ds max help tab, I have tried it all, to be honest, I just might start modeling in something else soon, I do not know, anything to save money.

I am just as good in milk shape, but the faces are all triangles.

There is a slight error with that assumption. If you bring the media into Max to rig or alter, then export to another format for another program (such as Milkshape, Blender, etc), you cannot distribute or sell it, unless the "rental EULA" says different. For example, one can't use the "student license" of Max to rig a model, then export to Blender and provide for sale an .obj or .x file- it violates the EULA from AutoDesk. It may seem easy to say "don't use the Max files- just use the .x files", but those of us that have commercial products cannot release developments using media that was used in Max- unless the rental EULA says it is permitted. This way you are protected, we are protected, our customers are protected. That was why we were asking, since we never had to use a "rental" option ourselves.

So it is. LOL I never even noticed that before (learn something new). The last Max app we had to buy was in 2009 and have not bothered since then as our current products do exactly what we need. Besides, last time it cost me a car to buy these apps- I can't afford another.

With my rental license you are covered as far as I know, I assume, I will contact them tomorrow to ask. but for now,just wait if you are worried about it.

Ok, I figured some thing out here, and worked all day on it, and it works, I created a MILK SHAPE RIG for talking people in dark voices, so now, all of you can use my models commercially. I already re created the homless guy in milkshape

this rig has all the same names and bone number so it is compatible all the same.

I will be working on making my talking people in milkshape form now on, I have my meshes I created when I had a license for 3ds max, so there safe, there just base meshes any how.


I contacted them with no reply yet, so maybe there just busy.

At any rate I Am moving away from 3ds max because of there tight restriction laws. I am considering using and learning blender for new meshes.

You could always try truespace for your meshes. Much easier than blender and it's also free. then use milkshape to rig and animate.

Thank you, but I started tutts on blender today and found, well, IT IS BETTER THEN 3DS MAX IN A LOT OF WAYS. Well, for me, I learned how to create a cup today to learn the controls and it turned out real nice.

Then I loaded one of my meshes in to edit it and WOW, I love it so far.

My wife's a photographer and artist so I trade new guns for new camera lenses. I guess I messed up when I bought her the new car for no reason...
