hmm....man, I think I was able to the export with a max6 trial (is available at discreet site, for free, full for 30 days, along with character studio 4.2) the biped character, weighted with physique. Was a model from other person. Actually I only intended to test the panda exporter.
There's also the Microsoft extras. Is a donwload you can find at microsoft, as isolate download(huge anyway, now it's bout 165 mb or so), but also you have the sdk...actually, these days I think the compiled plugins are finally available. Not sure though. In those Extras download for directx 9.

hmm...and can't find now the extras download for dx9.0b...in theory, it should have the plugins for export for max 5. I suppose you use max 5...
OPTION B)
Pass me (I'll have to pm you first) the exported u3d file. I use Ultimate unwrap to convert that to directx8 animated file you should be able to use then.
What's an u3d file? Ultimate unwrap format. Is free. You download it and put the plugin that is inside the zip into your Max plugins folder. Restart max and then in Max "export" dialog you will be able to export as u3d. All this is only if you have Max 5 or 5.1. Better if have Max 5.1 and character studio 4.1
I rarely do something like this but seems you're in trouble with your uni project.
In fact, I have largely tested this method. Is likely sure to work.
