I've taken the time to translate a number of their Japanese language documents including their charter. I 'moderate' the DoGA English language BBS. I communicate a few times a year with Team DoGA. I've personally asked for and have gotten permission for game development from Team DoGA.
I can not speak for them in an official capacity. But in general, once you export away from DoGA (say, to an .X file) you're in the green, especially if you use custom textures to replace DoGA's defaults.

The translated Bablefish text is hard to follow, but this is the gist of it. Team DoGA owns the parts, but the author owns the images, movies, and models made from the parts. As long as you do not package and re-sell their parts, they have no problem with that. Trying to contact them and let them know that you are using DoGA for a commercial application is a good manners. They don't charge royalties or licensing fees.
