DavidT did not trademark the name, LucasArt (who Pandemic made Mercinaries for) did.. Name Trademarking generally costs $6,000 so, if you care to stump up that cash for DavidT's lastest version then by all means

Also, he discovered this for himself about a year ago.

I made a game called Mercenaries waaaaay before this Lucas Arts game was even a twinkle in George Lucas's eye, suffice to say I'm not pleased

Yeah it depends. They are not generally protected. Apple (Apple Corps, Ltd. founded by the Beatles) for example has been a record company long before Apple computers came to existance. They were OK with a computer company called Apple (they even had an agreement) until Apple Computers started their iTunes.

I think you're taking this a little too seriously Nukesoft. I'm sure there have been many freeware/shareware indi games that shared the same name before LucusArts or Davids game came along. It's downright stupid and ignorant to expect them to think up a name no indi developer has ever used beforehand.

On the other hand, like David suggested, if they were to try and force David to change his games name, so long as David can prove he used the name first, they can't force him to do anything (as far as I know).

I don't think so. Look around product sites from companies like Adobe or Corel and note how products with generic names have the all rights reserved symbol after their name, while products with original names (tend to) have the trademark symbol. There are some exceptions but generally speaking, you can't just protect any given word. And even if you do, chances are it won't hold up in court.

Well seeing as how Lindows was forced to change its name after being help up in court, I'm certain that nobody could use Word, Publisher, etc. without being driven out of business.

To be honest I have a hard time believing he started the site with no intention of annoying Microsoft, and following the basic decency that Microsoft themselves lack, he could have changed to it to MRowesoft or MikeRsoft or MichaelRoweSoft or whatever and not pushed the territory line. But hey, Microsoft doesn't play fair, so it's no big deal if someone plays dirty in return .
