I looked up copyright laws on here already, but it wasnt really what i was after. While the original post was asking about remake of already existing games, I'm wondering about movie games. Me and a small group of friends want to make a game based on a GREAT cult japanese film called 'battle royale'. Basically it would make a great game, as it has a strong story and lots of 'action'. I'm sure some of you will have seen it anyway. So is it illegal to make a game based on it, bearing in mind that a) the director and creator of the film is now dead (may he rest in peace) and b) we will not be making any money from it whatsoever? I know very few of you will be law students or anything, but hopefully we can piece together an unfortuently unclear law.

Nothings illegal if you dont sell it, or profit from it (advertising)
If you think you can make the game, go for it. A team of high priced lawyers isnt gonna bust down your door and stomp your hdd into a small pile of scrap.

I aggree,
look at all the different versions of the "tron" game.
It should not be a problem as long as
1 - you do not use any media from the movie
2 - do not try to "emulate" media from the movie
3 - do not say your game is sponcered by anyone
related to the movie

being "inspired" by a movie is OK though. Heavy Metal 2000
had nothing to do with the original, but Fakk2 was
more than "inspired" by HM2000. Also, lets not forget
Shiny's Alice .... "inspired" by "Alice in Wonderland" but
bent over and ........

Ummm... we wanted to record sound from the film. Bearing in mind we will not be selling it, is that still illegal? We can do with out the sound clips I guess, but it would make a slightly lesser game. But thanks for the response guys, and yes, we're pretty sure we can make it.

check out the riaa site under piracy and copyright. Click some of the links and you should be able to find the laws for copyrights.

Yes. That is a definate no no. Even if you do not make money from it, you would be distributing it. That's piracy. That would be no different than copying a music cd and posting it on the web for download. Don't do it.

On the other hand,
You can place "markers" in your code where such effects could be inserted later. Then, when your game is in pretty good shape, try and contact the copywrite holders (publishers) and present them with your ideas and ask if you can insert thier media at those marked locations. Not an easy task. Those guys are hard to contact on purpose. Once your game is ready, it still could take a year just to reach them, and then, they will want a top notch product to review.

I think its fine, as long as you don't use ANY media from the film, (clips and sound tracks) as this is all COPYRIGHTED!

The fact that your not going to be making money on it makes it all alright.

P.S. Stop asking questions and write some code! Finish the game (I know you want to, and Gary needs to do some work now that hes got his notebook) and then worry about copyright!

Cause the worst that can happen is you will need to change a few details. (Characters, Music) This will be easy compared to actualy makeing the game, writing the code, modeling the weapons and characters.

+ I want a copy A.S.A.P (as you know i have seen battle royale, a great film, now i want to play the game!!!!)

when will the game be out? Not for a long time. I'm still at school, doing an extra year, so the only spare time i'll have is at weekends. However, I at least have my heart set on it so it'll get done... eventually. Just contact me if you want a copy. I'll store your e-mail somewhere and if and when it gets done I'll send out copys. We're gonna need testers at some point anyway.
