Hey all,
I was wondering if anyone knew if the copyright law in the US (and in most other developed countries, i would assume) is its illegal to even MAKE something based on copyrighted material, such as if i were to MAKE a star wars game and not distribute it, would it be copyright? Or is it if you DISTRIBUTE it, or is it only if you SELL it?

Yeah, lol, but if u do get caught, its illegal, and you can be fined thousands of dollars and be put in jail for up to 5 years, hehe.

As for star wars, George Lucas does not mind if you make star wars based games, as long as you don't sell them. Some companies will, however forbid ANY reproduction of their material, sold or not sold, distributed or not.

Last night I was looking up at the stars and said "Where the hell is my roof?!"

The answer to your question is: creation. If you create a work which infringes a copyright work, you are in breach of the copyright in the original work.

Infringement occurs literally or non-literally. Literally is, as you might expect, the direct copying of a work. For example, by copying a computer file, by photocopying a page of text, etc. Non-literal copying is more complex but basically amounts to copying the idea and the "look and feel" of the original work.
