depends on what you define as "spyware", yes they watch what you are using the program for, but only to make it better, no personal information is gathered. They give you that warning before you even install it. If you don't want it, don't install it.
The difference between this and spyware is that it's
A) Legal
B) Doesn't collect personal information
C) Tells you exactly what you are installing, a lot of times, SPYWARE is installed without you even knowing, or hidden in the EULA somewhere, whereas Google says in big red letters "PLEASE READ, THIS ISN'T THE NORMAL YADDA YADDA" at the top of it's own page, and explains what they are doing.
Very nice program tho. I might even make it stay on top of my programs for when I'm writing or browsing the internet or coding. They have some nice extensions that would only be useful with it always on top (like controlling your media player, and lots of others)
What they really need to do is make it so you can CHOOSE what programs to stay over (like the web browser and word processor, or whatever else you want) or make it pop out when you put the mouse on the side of the screen.
That would be neat...shame I don't know C++ well enough to make my own extensions for it
