DarkBASIC Professional Discussion / Is it leagal to sell my games I make with Dark BASIC Pro???

Some one answer --- am I allowed to sell what I make - I mean, it is my work after all, its not like I am trying to sell the examples...

You can sell what you make royalty free; meaning you don't have to pay TGC a percentage of what you make.

Of course there are conditions.

1) You may not use other users or developers resources (ie. Music, Models, textures or any other created content) with out that person or developers consent. Freeware, open source and freely given items are considered permissable.

2) It helps if the game is original but remakes are okay, but be careful of using trademark characters or story elements in your game or creations. Commercial developers may send you a cease and disist order if you try to make money from thier characters or work. This is considered a requirment to protect trademarks and copyrights.

I'm sure there are more but these are the main issues that you have to keep in mind.

It's kind of strange that there's no license refrence in the manual, so it's not a stupid question.

Anything you make on DBC or DBPRO is absolutely royalty and wotnot free- do what you like, put it on the web, send it here, distribute it- make something like that guy with star wraith, and release it upon the world to become as famous as I really want to be...

It's not mentioned in the manual, or durring installation so it's not stupid. Not everyone that will purchase this product will have access to the internet. They can't all be wired nerds like us. And by "US" I mean I am my greatest fan.

Yup, it certainly was spelt wrong...But since a majority of the DBP population is 10 or under as demonstrated by including "SOFTWARE" in their username, you can't really hold that over his head.

aslong as your friend purchased it, and didn't make backups or copies for himself or you or anyone else then it's fine.

Peace, fellows. On the one hand, whether someone purchased DBPro on the internet or elsewhere, one would most likely have to get to the internet site to post a message in a forum. The main page does address the issue: "All games created with DarkBASIC Professional are License and Royalty free." On the other hand, not everyone reads every line.

But lurking in that posted assurance is the minefield, and DBoy780's warnings SHOULD BE HEEDED. I have specialized in copyright infringement law for several times the lifespan that Tapewormz ascribes to the majority of the DPP population. I can't even count at this point how many times someone has knocked on my door having received a summons in a lawsuit for an expedient as simple as jacking a portion of an image as an element of a backdrop to an otherwise original work, e.g. an ad for an unrelated product.
