I am making a new freeware arcade racing game and is it legal to include real car manufacturers and real car model names? For example if im using "Ferrari 348 Spider" car in my game would it be legal?

I think until it's freeware the answer is yes!
Not shure on 100% so i better ask now than changing something later when the game is released.

Just because it's free it doesn't mean it's legal.

The problem you will most likely have is "misrepresentation of the product". If your game doesn't meet the expectations of their brand then they will not be happy.

But as always with these threads...how interested are Ferrari going to be in a sole developers Freeware game?

Ofcourse they wont be interested in it as im going to implent very detailed car destruction possibilities!

Anyways i think i better do like Sunrise 3D said, will rename my cars and all that stuff. Ferrari might be .... eee... Farr 843 Buster, LOL!

I remember a long time ago a game was made, I think it was Porch, but the car was not allowed to be damaged due to restriction by the company. (might not have been Porch, can't remember.)

Well, it's freeware, so no one will care. If you make dumb names for the car, it might just seem dumb.

Unless I misunderstood, I think you mean Porsche.

Speaking of which, I think this has got to be one of the ugliest cars I have ever seen.

No! You did not just say that the Porsche 911 GT2 was ugly! It is so beautiful. Porsches are the most beautiful cars on the planet, in my opinion. I have over 100 pics of Porsches for my desktop and screensaver...and I will someday own one...a Porsche 911 Carrera Cabriolet S perhaps...

Yes I did.

Well cars are more of a taste left to the individual, as beauty is in the eye of the beholder. I, however, find this to be the best car in the entire universe since the existence of time.

Yeah, I know, I was just joking. I'm not going to judge anyone based on their tastes. Okay, nevermind, I will, haha

I'm not going to lie, that car is flipping awesome. Looks like a modified Corvette...maybe '75? I was going to say it looks like the batmobile...then realized it is supposed to

This is the closest thing I'll ever get to a DeLorean - it's a c1980s Volkswagon Scirocco. Fantastic stuff:

They updated it in 2000 to make it a bit more modern. I want one.

I drove 200 miles in the back of a Scirroco - I've never felt so claustrophobic in my life! They are, in my humble opinion, ugly inside and out. But boy do they shift!

I like the ford Mercury, and the Porche.

Talking of the Ford Mercury.........

I predict that the old car styles will be rebuilt by big companies as exact replicas, but with new engines inside, and modern dashboard accessories, plus better paintwork, not rusting so easily.

Yeah, the DeLorean is quite possibly the best example of a cheap knock-off sports car. Unfortunately though, sports cars generally go very fast, performance wise, the DeLorean was very poor. Can't exactly say it did well on the market, although it does have a fairly large cult following, albeit, I'd imagine Back to the Future played a large part in that. You've got to give them credit for having the balls to produce 3 of these, though:

(That's a 24k gold exterior, apparently it can cost in the order of $24,000 just to repair a small dent in it)

I wouldn't mind being seen in that.

One BIG thing I hate about cars is when people take vintage cars and hot rods and feel the need to paint them candy apple red. Or even worse, candy apple red with yellow flames. I saw a car like that yesterday, it looked like an over-condimented hot dog, and I laughed when I saw it. Like this:

except on a car, and without the purple tips. Just two straight colors.

Hey guys you went off topic, so what do I need to do with my real car names? Remove them or leave as it was?

If I were you, I'd just make up my own names, makes it seem more original, and keeps you out of trouble at the least. But if you prefer to stick with other car names, you probably won't see too much of a problem, as the big car developers aren't likely to notice anyway.

names like

FROD=FORD
FOXHALL=VAUXHALL
CORPORAL MOTORS=GENERAL MOTORS
POINTYAC=PONTIAC
SCHRODA=SKODA
DATMOON=DATSUN
TOMATA=TOYOTA
PORCHY=PORSCHE
FEARARI=FERRARI
RAMBOGINI=LAMBOURGINI
ALDER CHROMEO=ALPHA ROMEO
LITUS=LOTUS
VOLTSVAGEN=VW
CATYOUAR=JAGUAR
FIDO=ROVER
LOUDI=AUDI
ZAAB=SAAB
LOWUNDAI=HYUNDAI
etc.....

that way they sound like the cars they mimick but they don`t actualy have the same names and most people could work out what they where meant to represent, tbh getting ALL the major car manufacturers to give you permission to use their names is gonna be almost zero, esp with things like that car advert promotion that got hijacked and made into an anti-advert currently in the news, best to just imitate, nearest I can think of was a guy on the Amiga who made a game called UFO-Enemy Unclothed, a mickey take of UFO-Enemy Unknown involving flashers rather than aliens, in his game UFO stood for Unidentified Flashing Object and the organision was called X-Pants, he wasn`t asked to drop it, as long as it doesn`t directly impact Frod or Corperal motors you should be ok, and they have to give you a chance to remove it 1st anyway.

You could also make names that sound like they would be car names/companies.

Smith Motors
Gladstone
Turrey Motors
Preston GTX
Washburn FF-5
Satoshi
San Grosan
Regal Motors
etc...

I mean, most companies are just people names, anyway.

feel free, use any of those names as you please, I would never get round to doing anything with them anyway, I`m mr 90%, I get a game 90% done and then lose interest and scrap it, theres no fun in it once you`ve solved all the problems, plus most of my games look like they where coded for a ZX Spectrum, force of habit, I think ascii gfx are cool , thats what being old does for you.

That will rule

For those of you interested, Canada produced the Bricklin, which preceded the Delorean by about 5 years, and it had the cool vertical doors. I see them every year at the Father's Day car show--- soooo beautiful!

Yes, those gull-wing doors sure are fancy... until you bump your head on them when getting out. That wouldn't stop me buying a Countach, though.

I don't think using different car names is going to seriously hinder your project, just look at GTA, they've used alternate names since GTA 1 and still are in San Andreas, and we all know how popular those games have been.
