Yes, HJS is copyright.

And to the left, it looks like a copyright. Besides, that wasn't somthing from a show and it was made by some person some from site, so you don't know how much freedom it has.

It still shouldn't be used in commercial games.

Don't mean it's not copyrighted, though...

Code Master is right, just because the image doesn't show it, chances are the website you got it from does.

Basically, the Simpsons, all Simpsons characters, and logos etc. are copyrighted by Fox. You always see that "All names [sometimes], characters and logos are copyright Fox, 2006", or something like that.

I've seen simpson stuff in other fpsc games that my friends made, they sold it and ...................................................
.............................................................................................................................................................................................................................nothing happend.

p.s. I didn't say it wasn't copyrighted, I said that what people thought was a copyright was just homer's name

Shade, naturally chances are that neither Fox nor Matt Greoning are going to track your friends down and arrest them. They don't have the time--they have to use that time to make more sub-par programming .

But anyway, the fact is that the actual picture itself was drawn by the Simpson team, so it's probably copyrighted.

Whether that means you can use it in your game at all (freeware or commercial) is still unbeknownst to me. I do know that either copyrighted or trademarked material (one or the other) cannot be used at all, whether commercial or not, so you'd have to check that out first. Of course, the laws of copyright is shady because it are different in different countries (like how in the UK, your work is automatically copyrighted, but in the USA, you need to apply before it is officially recognised).

And above all that, I may be dead wrong .

I read at the U.S. Copyright Website that everything here is automatically copyrighted, just you can't sue them cus it's not official. Is this correct or do I need to spend some money??

It's just better to play it safe, until you can find real legal eveidence that the use of the image is OK. Of course, if you're just making it for your own amusment and it never leaves your PC, then I don't suppose it matters. Now I've got a "Smurf-Hunt" game to make.
