Hey, I'm working on making a fairly ambitious project in which I need about 100 photographs of peoples faces... I decided the easiest, fastest, cheapest way would be to jack ppls faces off from their myspace pages.

I'm planning on asking first but in case i forget or happen to miss one or something or get lazy or something I wondered if there were any sort of laws on stuff like that.

I'm guessing no since its posted online for public veiwing and since (i hope) they didnt copywrite their face.

Anyone know of the laws reguarding "stealing" someones facial picture?

Obviously there is a law against you taking someone else's photo of their face and putting it in your game, especially if you're selling it. Why wouldnt there be?

Itd be like me filming the inside of your house for part of a movie while you were out, without me telling you about it.

Actually, through the Berner Convention, every single item on the web is copyrighted unless stated otherwise. So yes, there could be legal steps against you, especially as you're also breaking portrait rights. I've not found any proof of such a law existing except for here in the Netherlands, but I can bet you that there is.

Suicidal, thats what I was saying with the house analogy. Your house is on the street, visible to anyone that walks by, but that doesnt give them the right to use it in a movie without your permission.

They're right SS, but really, nobody will care. You won't get sued. If EA did it there would probably be problems. If a guy making a little game does it, no big deal.

I'd just jack the faces, but don't take TGC member faces. Asking for forgiveness is easier than asking for permission, after all.

Agreed. No offense but the chances of this game being heard from by anyone past these forums is really slim other than your immediate friends, let alone the people from myspace who's pictures you used. Even if you do try to make money off of it, unless your project gets to be as successful as Cash's or Fallout's or something similar, nobody will really care.

1. While it's in development then who cares? You can always change things when it's ready for release
2. It's amazingly unlikely the people are going to find out

4. If it's freeware then I seriously doubt anything will happen apart from someone asking for their face to be removed
5. You can change it to someone else's face if someone complains
6. Any Photoshop/PSP filters that could easily hide a person's identity and still get what you want? Think those art/cartoony ones could be good, and no-one is going to know it is them
7. Try finding dead people
8. If you are under 18 then what are they going to do? Get away with murder at that age. I saw a "Cops" type program in the UK that said this bloke who got caught 200 times joyriding (and still lived at home, went to school etc) went on a major high speed joyride through the centre of a city on the eve of his 18th or 16th birthday (can't remember which one they throw the book at you). Helicopter coverage was pretty good...

I had the same problem, i needed faces but didnt want to just rip em from the web so I asked here for people to post pics for my game and I got alot of responses.

Make the program download random profile pics from MySpace, if possible. Explain to Microsoft what you're going to be doing and see if they give permission.

I think the extent to where people will be annoyed or not depends on the contents of the game: if you use someone's face and tack it into a porn (or other debatable taste) game you may get into trouble - or at the very least get a lot of hate mail.

In a nutshell: feel free to put my face on a ravashing action hero, but not on some emaciated weakling that gets sodomised onscreen.

Why not use www.sxc.hu. Theres loads of really high quality photos of people and theyve been posted on this site just for other people to use in any projects. Its going to be much better quality and less risky than using photos from myspace and long as youve got permission from the photographers theyre all going to be free to use (legally) in a commercial product.
